LithicScan Terms of Service v1.5 — UK Beta Pre-publication Review
Release candidate for director approval. Effective on the date the final documents are published and accepted.
Version 1.5 · Effective date: 21st October 2026
The short version
This summary helps you find your way around. The full Terms below are what count.
• Who we are: LithicScan is provided by Neurolithic Institute Ltd, a company registered in Cyprus. You must be 18 or over to use it.
• What it does: LithicScan measures your facial proportions with your iPhone camera and compares them with reference values. Your results are educational. They are not a diagnosis, not medical advice, not a medical assessment of your health and not a statement about your ancestry.
• The beta: The beta is free and experimental. Scores can change as the reference is built and our methods improve, and past results may be recalculated. The Beta Addendum explains what this means for you.
• Your data: Your scan photos stay on your phone; we store numerical measurements and your answers. The Privacy Policy explains how we use your data.
• Separate choices: Accepting these Terms is not consent to research, promotional emails, the use of your ancestry or the world figures. Each is a separate choice you can change at any time.
• Leaving: You can delete scans or close your account at any time, free of charge.
• Fair use: Use LithicScan only for yourself, and never to judge or discriminate against anyone.
• Your rights: Cyprus law applies, but you keep the consumer protections of the country where you live.
1. About these Terms
1.1 Who we are.
LithicScan is provided by Neurolithic Institute Ltd ("Neurolithic", "we", "us" or "our"), a company registered in the Republic of Cyprus under registration number HE494385, with its registered office at Dimitri Charalambous 13, Office 4B, 3020 Limassol, Cyprus. In these Terms, "Neurolithic" means Neurolithic Institute Ltd only, not any other business that uses the Neurolithic name.
1.2 What these Terms cover.
These Terms of Service ("Terms") are a legal agreement between you and us for your use of the LithicScan app and the features we provide through it ("LithicScan"). They do not cover other Neurolithic products and services, such as courses, the Neurolithic Academy, supplements, the podcast or the Neurolithic website, or planned services such as LithicGenes and LithicTrace. Those have, or will have, their own terms.
1.3 The Beta Addendum.
While LithicScan is in beta, the LithicScan Beta Testing Addendum ("Beta Addendum") also applies and forms part of our agreement with you. If the Beta Addendum and these Terms conflict on a matter that concerns the beta, the Beta Addendum applies. Nothing in the Beta Addendum reduces your statutory rights or your rights under data protection law.
1.4 The Privacy Policy is separate.
Our Privacy Policy explains what personal data we collect, how and why we use it, who receives it, how long we retain it and your rights. We make the Privacy Policy available during registration and in Profile. When you accept these Terms, you acknowledge that we have provided access to the Privacy Policy; it is a notice, not part of this contractual agreement. This acknowledgement is not consent to any processing for which separate consent is required, including optional research or the uses described in clause 18.
1.5 How you accept.
You enter into this agreement when you create your LithicScan account and actively turn on one off-by-default agreement switch stating: “I agree to the LithicScan Terms of Service and Beta Testing Addendum, and acknowledge that I have been provided with the Privacy Policy.” We provide separate, accessible links to the Terms, Beta Addendum and Privacy Policy before you do so. We record the versions of the Terms and Beta Addendum accepted, the Privacy Policy version presented, and the date and time. Existing users will be asked to accept the updated agreements before continuing to use the app; they can instead sign out. There is no separate beta-limitations acknowledgement switch.
1.6 Keeping a copy.
You can read the current Terms at any time in Profile and at the published Terms link provided in the app, and save or print them from there. If you ask, we will send you the version you accepted. These Terms are available in English only.
1.7 TestFlight and the developer name.
During the beta, Apple distributes LithicScan through TestFlight using an Apple developer account held by Lee Glanville, a co-founder of Neurolithic, so TestFlight may show his name as the developer. LithicScan is provided to you by Neurolithic Institute Ltd under these Terms. The account arrangements and the handling of tester data must be documented by the company.
2. Who can use LithicScan
2.1 Age.
You must be 18 or over. LithicScan's measurements assume a fully grown face, and the app blocks sign-up for anyone whose date of birth shows they are under 18. If we learn that an account belongs to someone under 18, we will close it and handle the data as the Privacy Policy describes.
2.2 Personal use.
LithicScan is for individuals using it for their own personal, non-commercial purposes. You may not use it for a business or other organisation, or to provide services to others, without our written agreement.
2.3 Where LithicScan is available.
This beta is offered by invitation to adults resident in the United Kingdom only. The Beta Addendum explains the beta eligibility rules. We may make a later release available in additional countries under updated terms.
2.4 One account, your own face.
You may hold one account only, and scan only your own face. Our reference values count each person once, so a second account, or scans of anyone else, would distort results for everyone.
2.5 Devices.
During the beta, LithicScan works on iPhone only, installed through Apple's TestFlight app. It needs a working front camera and a supported version of iOS. TestFlight identifies compatible devices and software versions.
3. Your account
3.1 Accurate details.
Keep your details accurate and up to date. During this beta, the sex field offers Male or Female. The sex you record determines which reference values your results are compared with; changing it recalculates your results against the other reference. Your date of birth is used to confirm you are 18 or over.
3.2 Signing in.
You sign in with a one-time code sent to your email address; there is no password. Keep access to your email account secure and don't share sign-in codes. Tell us straight away at info@neurolithicinstitute.com if you think someone else has used your account.
3.3 Responsibility for your account.
You are responsible for what is done through your account, except where someone used it without your permission and you were not at fault, or where the problem was caused by us.
3.4 Messages we send.
We send essential emails about your account and the service, such as sign-in codes and notice of important changes. You will receive these while you have an account. Promotional emails are a separate choice (clause 18).
4. What LithicScan does
4.1 In short.
LithicScan uses your iPhone's front camera to measure the proportions and symmetry of your face. It combines some of those measurements with your answers to short breathing questions, compares the results with reference values, and shows them as scores, charts and comparisons.
4.2 The main features.
LithicScan currently includes:
• Face scans. Each scan takes five photos. They are processed on your phone, and the app checks light, head position and other conditions while you scan.
• Health Form. A score from 1 to 10 showing how close your Health Form Metrics sit to the Neurolithic standard, a reference point Neurolithic has defined to reflect faces that developed in conditions closer to those humans evolved in.
• Health Form Metrics. Face length (TFI), width-to-height ratio (fWHR) and facial symmetry (FA).
• Airway Index. A score from 1 to 10 that combines your face length with your answers about how you are breathing now.
• Breathing check-ins and Track Progress. Optional weekly questions and charts of your Airway Index and breathing score over time.
• Your average and Scan History. Your results across scans, and a record of each scan.
• Population Comparison, the human story timeline and skull twins. Comparisons of one facial proportion with prehistoric and historical populations (clause 7).
• Health Form worldwide and Explore the Neurolithic standard. A world map of combined Health Form figures, and a screen showing how the standard is built.
• Share cards. Images of your results that you can choose to share (clause 13).
• Use my photo. Where available, an option to see where each measurement is taken on a photo of your face that stays on your phone.
4.3 Previews and example data.
Some features show example data until enough people have taken part, including Population Comparison before it unlocks and the Health Form worldwide map. Examples are labelled, for instance "Preview · example data". They are not your results or anyone else's.
4.4 Features marked "coming soon".
LithicScan mentions products that are not yet available, such as LithicGenes (a planned saliva DNA test), LithicTrace (a planned diet test using a nail clipping) and Neurolithic courses. Tapping to show interest records your interest only. It is not an order, it creates no obligation for you or us, and it does not guarantee the product will be offered. Any product we do offer will come with its own terms, and we will tell you before using your data in any new way.
4.5 What LithicScan is not.
LithicScan is not a medical service (clause 6), not a genetic or ancestry test (clause 7), and not a tool for assessing other people (clause 9).
5. How your measurements and results work
5.1 Measured over skin.
The camera measures the surface of your face, not the bone beneath it. LithicScan's measurements are approximations for comparison, not exact anatomical measurements.
5.2 Conditions affect results.
Light, head angle and tilt, distance from the camera, expression, whether your lips are closed, glasses, hair and your phone’s camera can all affect a measurement. LithicScan checks conditions and may ask you to adjust. Scans flagged by some capture checks, such as head angle or uneven light, are left out of Your average, and the app tells you when this happens. Reference calculations use only scans that pass all applicable quality checks.
5.3 Comparisons, not verdicts.
Your results compare your measurements with reference values. Some reference values come from published scientific data, such as skull measurements of historical and prehistoric populations. Others are being built from LithicScan users, who during the beta are a small, self-selected group and not representative of any population. Reference values are provisional and will change (clause 8).
5.4 Health Form.
Health Form describes how close your facial proportions and symmetry sit to the Neurolithic standard. It is not a medical assessment: it does not tell you whether you are healthy or unwell, and it is not a measure of your fitness, attractiveness or worth. A lower score does not mean something is wrong.
5.5 Airway Index and breathing scores.
The Airway Index combines your face length (TFI) with your breathing answers, weighted 60:40. That weighting is a design choice, not a measured result. Your breathing score reflects your own answers, not a measurement of how you breathe. Neither score measures your airway, lungs or sleep, or shows whether you have a breathing or sleep disorder.
5.6 Symmetry.
Small turns of the head can raise your symmetry (FA) reading, and so can past injury, dental work or swelling. A change between scans usually reflects capture conditions rather than a change in your face.
5.7 The science is still developing.
Neurolithic's approach draws on research into evolutionary mismatch and facial development, including the hypothesis that childhood breathing may contribute to facial shape. These are open research questions. Associations found in studies of groups do not show what is true for any one person, and LithicScan's scores have not been validated as measures of any health outcome.
5.8 Childhood answers, research and the TFI reference.
Childhood breathing and diet questions are asked for optional Neurolithic research, not to calculate your individual scores. They are used for that research only with your research permission. Separately, if you give the specific optional “Help set the face-length standard” permission, authorised childhood breathing, dental and surgical-history answers may be used to select the subgroup used to set the face-length (TFI) reference. This requires the underlying research and dental/surgical-history permissions to remain active. Without the separate TFI permission these answers must not be used to decide subgroup membership. This use helps establish the shared reference; it does not directly alter your individual measurement.
6. Not medical advice
6.1 Educational purpose.
LithicScan is for educational and research-related purposes. It does not diagnose, treat, monitor, predict or prevent any disease or medical, dental or psychiatric condition, and we do not intend it to be used as a medical device. It is not a substitute for professional healthcare advice.
6.2 Don't rely on it for treatment decisions.
Don't use LithicScan to decide whether to seek, start, change or stop any medical, dental, orthodontic, surgical, breathing or sleep treatment. If you have any concern about your health, breathing, sleep, teeth or face, speak to a qualified healthcare professional.
6.3 Questions are not recommendations.
LithicScan asks about things like mouth breathing and mouth taping so it can track your answers over time. Asking is not a recommendation, and LithicScan does not advise you to tape your mouth. LithicScan may link to Neurolithic's Breathing Course, a separate product with its own guidance and terms. LithicScan's scores are not evidence that the course, or any breathing practice, will work for you.
6.4 Not for emergencies.
No clinician monitors LithicScan. If you need urgent help, contact your local emergency services.
6.5 Product names.
Names and phrases such as Health Form, Airway Index and "biological health signal" reflect the research ideas behind LithicScan. They do not mean that LithicScan assesses, diagnoses or predicts your health.
7. Population Comparison, the timeline and skull twins
7.1 What Population Comparison does.
Population Comparison automatically compares one facial proportion from your scans, the width-to-height ratio (fWHR), with reference values for four groups: Neanderthals (three male fossil skulls), Palaeolithic European foragers (skulls from about 36,000 to 12,000 years ago), pre-industrial farming populations (skulls from about 3,000 years ago to the early 1900s) and Dragon Man (one fossil skull). It shows which group your proportion sits closest to and ranks the others. When the two closest groups are too close to call, both are shown, and Neanderthal is shown first only when the result is clear. Because LithicScan measures over skin and the reference values come from bone, each group is placed by how far it differs from people scanning today, not by its raw skull values.
7.2 Resemblance, not ancestry.
Population Comparison shows resemblance in one measurement. It does not identify or estimate your ancestry, ethnicity, race, genetic make-up or where your family comes from. A face that resembles a group does not mean you descend from that group or carry its DNA. Population Comparison does not rank groups as better or worse, and it says nothing about your health. Separately, the Neurolithic standard used for Health Form draws partly on the skull proportions of historical foraging peoples. That reflects Neurolithic's research hypothesis about facial development, not a judgement about any people or group.
7.3 When results appear and change.
Your own Population Comparison becomes available once enough people have scanned to set its centre (currently 20 qualifying people) and Neurolithic has approved that centre. Until then, the result is marked “Available soon”; the human story timeline may show a clearly labelled example. A Dragon Man result is shown only when it is supported by Your average from at least three counted scans and Population Comparison is available. Your result may change as the centre is established and updated, as you add scans, or if the method changes.
7.4 Skull twins.
Your skull twin compares your face ratio with a named fossil skull and appears after at least three counted scans and once Population Comparison has been unlocked. Before then, the timeline may show a clearly labelled example skull twin. It is offered for interest, not as a finding about your ancestry.
7.5 The human story timeline.
The timeline places your result alongside human species and populations for educational purposes. Its dates and figures are rounded, come from published research, and may change as research changes.
7.6 Your ancestry answer.
If you give your ancestry, it is not used to produce your Population Comparison or any other result.
7.7 DNA and diet tests.
Where LithicScan invites you to register interest in a DNA or diet test, the invitation does not mean your face predicts your DNA or your diet.
8. Reference updates and recalculated results
8.1 Why results change.
Your results depend on reference values and on the methods used to calculate them. Both will change, especially during the beta.
8.2 Reference versions.
Until the first full reference is approved, Health Form uses an interim formula and placeholder values, not the full Neurolithic standard. The first fuller reference is calculated once at least 50 qualifying participants, including at least 25 of each sex, have scanned. Further versions may be calculated as the qualifying cohort grows. Each new reference is reviewed and must be approved by Neurolithic before it takes effect. Each version is numbered and dated, and the app records the version associated with a result.
8.3 Recalculating your history.
When a new approved reference version takes effect, we recalculate earlier Health Form results, including historical scans, to keep your history consistent. Scans captured using an earlier measurement method may remain visible but faded and excluded from Your average (clause 8.4). Your scores and labels may go up or down because the reference changed, not because your face changed.
8.4 Method changes.
We may change how measurements are taken or calculated, for example which photos are used or how they are combined. Scans taken under an earlier method may be shown faded in Scan History and left out of Your average. They stay in Scan History until you delete them.
8.5 Valid reasons.
We make these changes only for valid reasons: to improve accuracy or reliability, to reflect a larger or better reference population, to correct errors, to reflect scientific evidence, or for legal, safety or security reasons. They are free of charge.
8.6 Telling you.
We will tell you in the app or by email about changes that significantly affect your results. If a change has more than a minor negative effect on your access to or use of LithicScan, we will email you reasonably in advance, saying what is changing and when. You may then end this agreement free of charge within 30 days of our email or of the change, whichever is later. Urgent security or legal changes may take effect first, and we will then email you promptly. You can also close your account at any time.
8.7 No promised result.
We do not promise any particular score, label or comparison.
9. Using LithicScan properly
9.1 Use LithicScan only for yourself, lawfully and in line with these Terms.
9.2 You must not:
1. scan anyone other than yourself, or scan a photo, video, screen, mask or other image of a face;
2. open more than one account, or give a false date of birth;
3. use any result, comparison or skull twin to judge, rank, screen or make decisions about another person, including for employment, education, insurance, lending, housing, healthcare, dating or law enforcement;
4. use LithicScan or its results to make claims about anyone's race, ethnicity, ancestry, intelligence, character or worth, or to promote discrimination or harassment;
5. present any result as a medical diagnosis, a genetic or ancestry finding, or an endorsement by Neurolithic;
6. copy, scrape, extract or redistribute LithicScan's reference values, content or methods, or access LithicScan by automated means;
7. reverse engineer, decompile or modify the app, except where the law allows you to do so despite this restriction;
8. interfere with, overload or test the security of LithicScan or our systems without our written permission, or try to get around its age, capture or access checks; or
9. use LithicScan to break the law or infringe anyone's rights.
9.3 If you break this clause, we may act under clause 16.
10. Information you give us
10.1 Accuracy.
Give accurate information as far as you know it. Questionnaire answers are voluntary, and you can skip any question, although some results need certain answers.
10.2 Your data stays yours.
These Terms do not transfer ownership of your personal data to us. They give us no right to use it beyond what the Privacy Policy describes and the choices you make.
10.3 Combined results.
We own the combined statistics, reference values and other results we calculate from many people's data, where these do not identify you. Results already calculated that cannot identify anyone, such as a past reference version, are not recalculated when you withdraw a choice or close your account.
11. Intellectual property and your licence
11.1 What we own.
LithicScan, including its software, design, text, illustrations, icons and share-card designs, and the Neurolithic and LithicScan names and the # brandmark, belongs to us or our licensors.
11.2 Published data.
Some reference values are calculated from scientific datasets published by other researchers. Those datasets belong to their authors or publishers.
11.3 Your licence.
We give you a personal, non-exclusive, non-transferable licence to install and use the LithicScan app on Apple devices you own or control, for your personal, non-commercial use under these Terms. Apple's terms for TestFlight, or later the App Store, also apply. This licence ends when our agreement ends.
11.4 Open-source software.
The app includes open-source software, such as Google's MediaPipe face-tracking components, which is licensed under its own terms. Nothing in these Terms limits your rights under those licences. The required notices will be made available with the app.
11.5 Your share cards.
You may share cards that LithicScan creates for you for personal, non-commercial purposes. Don't alter them in a way that misrepresents your result or what LithicScan says.
11.6 Protection of the app and non-public technology.
Our software, original design and content, non-public algorithms, scoring logic, measurement implementations, databases and technical documentation are protected to the extent provided by applicable intellectual property, confidentiality and other laws. These Terms do not give you any ownership of them or any permission to reproduce the protected elements of LithicScan outside the limited personal-use licence in clause 11.3.
11.7 No unauthorised extraction or replication.
Except where we expressly authorise it or applicable law permits it despite a contractual restriction, you must not: (a) copy or adapt protected app software, interfaces or content; (b) reverse engineer or decompile the software to discover non-public implementations; (c) use bots, scraping, bulk account creation, repeated systematic probing or similar methods to extract reference values, datasets or non-public scoring logic; or (d) use confidential beta technical materials obtained from us to reproduce the app or help another person reproduce it. The restrictions on automated extraction and probing apply whether the intended use is commercial or otherwise.
11.8 What these restrictions do not cover.
These Terms do not prohibit independently developing a similar idea without misuse of our protected works or confidential information. They do not override rights that cannot lawfully be restricted, including applicable rights to observe, study, test or achieve software interoperability, nor do they restrict lawful reporting to regulators, legal advisers or law enforcement. You remain free to share your own results as allowed by clause 13.
12. Feedback
12.1 Feedback is welcome and always voluntary.
If you send us ideas, comments or bug reports, you give us a free, worldwide, permanent licence to use them to improve LithicScan and our other products, without owing you anything. We don't have to use them.
12.2 Don't include other people's personal data or anyone's confidential information.
Check screenshots before you send them, as they may show your results or personal details.
12.3 Any personal data in feedback is handled under the Privacy Policy.
13. Sharing your results
13.1 How sharing works.
LithicScan can make a card showing one of your results, such as your Health Form, Population Comparison or skull twin, for you to share through your phone's share menu. Cards are made on your phone. We don't publish them or put them on a public results page, and they never include a picture of your face. Some cards are available only once a feature shows real results.
13.2 Your choices.
You decide whether to share a card, where, and whether your Health Form card shows your score.
13.3 Links on cards.
Cards include a link and QR code to our website, which has its own terms and privacy information.
13.4 After you share.
Once you share a card, others can see it and pass it on, and we can't control that. Others may misread a result, so think about who will see it.
13.5 Respect others.
Don't share anyone else's results without their permission, and don't edit a card to suggest a medical, genetic or ancestry conclusion.
14. Apple and other third parties
14.1 Apple.
You get LithicScan through Apple: during the beta through TestFlight, and later through the App Store. Apple's terms govern your use of Apple's services. Apple is not a party to this agreement and is not responsible for LithicScan or its content; we are. Clause 1.7 explains why TestFlight may show an individual as the developer.
14.2 Our service providers.
We use other companies to run LithicScan, for example to host our servers and database, keep backups, send emails and notifications, deliver app updates, and develop and support the app. The Privacy Policy describes them. We remain responsible to you for LithicScan under these Terms when we use them.
14.3 Face-tracking files.
Your phone downloads the face-tracking model and code from third-party hosts (Google Cloud Storage and jsDelivr). Scanning may not work while they are unavailable.
14.4 Links to other services.
LithicScan links to our website and may link to other websites and services, including Neurolithic courses. These have their own terms. We are not responsible for websites run by others.
14.5 Notifications.
If you allow notifications, Apple delivers them. You can turn them off in your phone's Settings.
15. Availability and changes to LithicScan
15.1 Availability.
We aim to keep LithicScan available, but it may be interrupted, for example for maintenance or updates, because of problems with our providers, or because of events outside our control. Where we reasonably can, we will give notice of planned interruptions.
15.2 Updates.
We update LithicScan regularly, sometimes automatically in the background. You may need the latest version to use some features, or to keep using LithicScan.
15.3 Changing features.
We may add, change or remove features for valid reasons, including those in clause 8.5, to respond to feedback, to change providers, or where a feature does not work well enough to keep. Changes are free of charge. If a change has more than a minor negative effect on your access to or use of LithicScan, we will give you notice, and you may end this agreement, as clause 8.6 describes.
15.4 Ending LithicScan.
We may stop providing LithicScan altogether. If we do, we will give you at least 30 days' notice where reasonably possible and explain how you can ask for a copy of your data before it is deleted as the Privacy Policy describes.
16. Suspension and termination
16.1 When we may act.
We may suspend or close your account if:
10. you seriously or repeatedly break these Terms;
11. you are under 18 or otherwise not eligible to use LithicScan;
12. the law, or a competent authority, requires us to; or
13. it is reasonably necessary to protect LithicScan, other users or our systems.
16.2 Warning first.
Unless the matter is urgent or the law prevents it, we will first tell you why and give you a reasonable chance to put things right.
16.3 Challenging our decision.
If you think we have acted wrongly, contact us (clause 24) and we will review the decision.
16.4 What happens next.
If your account is closed, your licence ends and your data is handled as clause 17 and the Privacy Policy describe. Clauses that by their nature continue after the agreement ends, including clauses 10.3, 11, 12, 19 to 21 and 23, continue to apply.
17. Closing your account and your data
17.1 Closing your account.
You can close your account at any time, free of charge, in Profile → Delete account or by emailing info@neurolithicinstitute.com. Closing your account ends this agreement.
17.2 What is deleted.
When you close your account, your account information, measurements and answers are removed from our active database once deletion is completed, and we ask our email provider to delete your profile. Deleted information may remain in database recovery history for up to 30 days and in separately stored backups for up to 90 days, which expire automatically. Technical logs are generally kept for about seven days. Your contribution to the world figures is removed at the next scheduled update, normally within seven days.
17.3 Research and combined results.
Pseudonymised research records are handled as the Privacy Policy describes. Combined results that cannot identify anyone are not recalculated.
17.4 Before you close.
You can ask us for a copy of your data before you close your account (see the Privacy Policy). Deletion cannot be undone.
17.5 Deleting the app is not closing your account.
Deleting the app from your phone, or leaving TestFlight, does not close your account. If you used Use my photo, that photo is stored only on your phone, is excluded from iPhone and iCloud backups, and is cleared when you sign out or delete your account.
17.6 Deleting individual scans.
You can delete a single scan in Scan History. Deleted scans are removed, not hidden, and Your average updates.
18. Privacy and your separate choices
18.1 The Privacy Policy.
The Privacy Policy, available in Profile and at the published Privacy Policy link provided in the app, explains what personal data we collect, why, who receives it, how long we keep it and your rights. Please read it.
18.2 Separate choices.
Accepting these Terms is not consent to the uses below. LithicScan requests the relevant permissions separately. Optional research permission governs collection and research use of childhood breathing and diet answers. Ancestry research needs its own permission; the optional TFI subgroup also has a separate permission. Turning off research ends linked dependent research and TFI permissions and deletes linkable childhood B1–B4, dental/surgical and ancestry answers and research copies, subject to lawful retention exceptions, backup expiry and the Privacy Policy.
Choice >> What it covers >> Where to change it
Current breathing results >> Use of current breathing answers and weekly check-ins for your Airway and breathing results, and related combined breathing figures described in the Privacy Policy. Does not authorise childhood research answers. >> Profile → Your data
Optional research >> Optional pseudonymised use of facial measurements and authorised questionnaire answers, including childhood breathing and diet, for research into facial development; can continue using childhood answers if you stop current breathing results. >> Profile → Your data
Dental and surgical history >> A separate optional permission to provide dental and surgical-history answers for research. >> Profile → Your data
Help set the face-length standard (TFI) >> Optional consent to use authorised childhood breathing, dental and surgical-history answers to select the group behind the TFI reference. Requires active research and dental-history permissions. >> Profile → Your data, or the “Our research” screen before the dental and surgical history questions
Ancestry >> Separate, optional consent to provide ancestry information for research on measurement performance across population groups. Not used for your personal results. >> Profile → Your data
World figures >> "Include me in the world figures", off unless you turn it on >> Profile → Your data, the world map or the timeline
Promotional emails >> Optional emails from Neurolithic, not pre-selected at sign-up >> The unsubscribe link in any promotional email, or by contacting us
Notifications >> Your phone's permission for LithicScan notifications >> Your phone's Settings
Use my photo >> Showing your own photo on your phone instead of the illustration >> Your average ("Switch back")
18.3 Changing your mind.
Withdrawing a permission does not end this agreement, but features that depend on it may stop working. Turning off permission to use current breathing answers for your results deletes current breathing answers, check-ins and associated scores and turns off the Airway Index and breathing check-ins. Childhood breathing and diet answers may remain only while a separate, valid research permission covering them remains active. Withdrawing research permission deletes linkable childhood B1–B4 answers and linkable research copies regardless of the breathing-results switch, subject to legal retention exceptions and backup expiry; it also disables dependent ancestry, dental-history and TFI reference permissions. Withdrawing the TFI permission stops future subgroup selection based on those answers. Previously approved genuinely combined, non-identifying reference values do not have to be recalculated solely because consent is withdrawn. Withdrawal does not make earlier lawful processing unlawful. See the Privacy Policy for more detail.
18.4 If the documents differ.
If anything in these Terms seems to conflict with the Privacy Policy about how we handle personal data, the Privacy Policy and data protection law prevail.
19. Our responsibility to you
19.1 Our commitment.
We will provide LithicScan with reasonable care and skill. During the beta, the Beta Addendum, which forms part of this agreement, explains known limitations and expected characteristics. Those explanations do not remove any statutory rights that cannot lawfully be excluded.
19.2 What we are responsible for.
If we break these Terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it was obvious it would happen, or if you and we both knew it might happen when you accepted these Terms.
19.3 What we are not responsible for.
We are not responsible for loss or damage:
14. caused by your breaking these Terms, or by your using LithicScan in a way that clause 6 or clause 9 tells you not to;
15. caused by events outside our reasonable control, as long as we take reasonable steps to limit their effects;
16. that is not foreseeable; or
17. to a business. LithicScan is for personal use, so we are not responsible for loss of profit, business or business opportunity.
19.4 Damage to your device.
If faulty digital content we supply damages your device or other digital content you own, and this would not have happened if we had used reasonable care and skill, we will repair the damage or compensate you.
19.5 What we never exclude.
Nothing in these Terms excludes or limits our liability for:
18. death or personal injury caused by our negligence;
19. fraud or fraudulent misrepresentation;
20. loss caused deliberately or by our gross negligence;
21. our obligations to you under data protection law, to the extent those obligations cannot be limited; or
22. anything else the law does not allow us to exclude or limit, including your statutory rights as a consumer.
20. Your statutory rights
20.1 Rights we cannot remove.
As a consumer, you have rights under the law of the country where you live that these Terms cannot take away, and nothing in these Terms affects them. A local consumer organisation can advise you, such as the Competition and Consumer Protection Service in Cyprus or Citizens Advice in the UK.
20.2 Ending at any time.
You can close your account and end this agreement at any time, free of charge (clause 17).
20.3 Fourteen-day withdrawal option.
In addition to any withdrawal right provided by applicable law, we offer United Kingdom beta participants the option of withdrawing from this agreement within 14 days of acceptance, without giving a reason. You may tell us clearly by email at info@neurolithicinstitute.com or use the model form in the Schedule, but the form is optional. You can also close your account and end this agreement at any time under clause 17. The beta is free, so there is no payment to refund. Personal information is handled as described in clause 17 and the Privacy Policy.
20.4 If LithicScan is faulty.
Depending on where you live, you may have legal rights if LithicScan does not conform to this agreement, such as having it brought into conformity. The Beta Addendum describes known limitations and the testing environment, but these disclosures do not remove rights that cannot lawfully be excluded.
20.5 Clear wording.
If any part of these Terms is unclear, the meaning most favourable to you applies.
21. Governing law and disputes
21.1 Governing law.
The law of the Republic of Cyprus governs these Terms. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country, which this choice of law cannot take away.
21.2 Courts.
You may bring a claim in the courts of Cyprus or in the courts of the country where you live (in the UK, the part of the UK where you live). If we need to bring a claim against you, we will do so in the courts of the country where you live.
21.3 Complaints.
Please contact us first at info@neurolithicinstitute.com. We will acknowledge your complaint within 5 working days and aim to give you a full response within 30 days.
21.4 Alternative dispute resolution.
If we cannot resolve your complaint, we will tell you which alternative dispute resolution body is relevant and whether we will take part. We do not commit to a particular voluntary ADR scheme by this clause.
21.5 Data protection complaints.
You can also complain to a data protection authority, as the Privacy Policy explains.
22. Changes to these Terms
22.1 Why we may change them.
We may change these Terms for valid reasons: to reflect changes in the law or regulatory guidance; to reflect changes to LithicScan, its features or our providers; to move from beta to public release; to make them clearer; or for security reasons.
22.2 How we tell you.
If a change materially affects you, we will tell you in the app or by email at least 30 days before it takes effect, explain what is changing, and ask you to accept the new Terms in the app. Where the law requires a change sooner, the notice may be shorter. Changes that are minor or only benefit you may take effect when we publish them.
22.3 If you don't accept.
If you don't accept a material change, you can close your account free of charge before it takes effect. If you neither accept the change nor close your account, we may end this agreement after the notice period, and we will tell you before we do.
22.4 Previous versions.
Each version of these Terms is dated. We keep previous versions and will send you any of them on request.
23. General terms
23.1 Transfer.
We may transfer our rights and obligations under these Terms to another organisation, for example if LithicScan is transferred to another company, but only if this does not reduce your rights. We will tell you beforehand, and you may close your account if you object. You may not transfer your account to anyone else.
23.2 No one else can enforce these Terms.
Only you and we have rights under these Terms.
23.3 If part is invalid.
If a court decides that part of these Terms is invalid or unenforceable, the rest continues to apply.
23.4 Delay.
If we don't enforce a term straight away, we can still enforce it later.
